I dont think THQ/WWE are that stupid. They might have contacted RVD/TNA to ask him if its ok to be included. It might be a privelage for him to be included in the legends.
Who knows, it looks too good to be a CAW

Some people said that they are photoshoped, that tha's the RVD model from HCTP, but look at this:

I doubt hardy will ever be included properly in a game now. He basically lied to the wwe about having the team off as he was burnt out, then went to TNA
