Lohan vs GTA is still happening

It has been quite some time since we’ve had any updates on Lindsay Lohan lawsuit against the makers of the Grand Theft Auto series for allegedly using her likeness in Grand Theft Auto V without permission.

 
As we previously reported, Lohan is suing Take-Two and Rockstar Games because she believes the character of Lacey Jonas in GTAV was an “unequivocal” reference to her. Take-Two claims that the only thing the two have in common is that both are young and blonde. Take-Two also went on to say that Lohan brought on the lawsuit for publicity purposes.
 
Many believed that this case would be thrown out before it even went to trial, such as the recent lawsuit by Manuel Noriega against Activision over his likeness being used in Call of Duty. According to the Hollywood reporter, whoever, New York Supreme Court judge Joan Kennedy wrote in a ruling on Friday that the case would not be dismissed.
 
Judge Kennedy ruled that going forward she “can’t rely upon defendants’ documents aiming to show the images in question don’t show Lohan.” Before this, Take-Two’s lawyers presented their own pictures which compared Lohan to the character in question. Kennedy also rejected Take-Two’s claim that Lohan brought the lawsuit too late, stating: “Defendants have not been able to prove, at this juncture of the litigation, that the republication exception to the one year statute of limitations is not applicable to this case because the intended audiences were the same as those of the original publication and the images consistently remained the same,” she wrote.
 
Lindsay Lohan isn’t one who is unfamiliar with a court room, given how many times she has been arrested for driving under the influence, among other things. Her luck with lawsuits isn’t much better either, so this situation can be seen as a small victory on her part. This lawsuit is still in its early stages however, so we’ll keep you updated on any new developments.

She will lose. The inspiration for the character is already credited and it isn't Lohan.

 

Try to stay relevant with lawsuits, Lohan, you can't do it with your acting career.

Now that's a really sweet case. Like seriously, to lawsuit a game which is in markets from more than 1 year for a character already credited. Haha, that's fantastic. xD
